The Stupid Justice System of US
0US, finally, is prosecuting some of the 9/11 suspects, detained in Guantanamo Bay but the saddest part is, it is prosecuting 5 alleged suspects before military court and whatever the outcome is, they will be held and will be treated as enemy soldiers.
US says they are responsible for 9/11 attacks and as evidence, they have produced some evidences which were gathered using various tortures like water-boarding etc.
The US always says they stand for democracy and human rights, no matter what circumstances or situation are. For many HR activists and countries, US is beacon of hope for HR. But this case proves that they too are no different than N. Korea or Iran, when it comes to their own interest. So why to play band proclaiming self as the only protector and promoter of Human Rights.
All the evidences against the accused are obtained using various tortures form like water-boarding (a form of torture that consists of immobilizing a person on their back with the head inclined downward and pouring water over the face and into the breathing passages. Through forced suffocation and inhalation of water, the subject experiences the process of drowning and is made to believe that death is imminent.), prolonged isolation, prolonged sleep deprivation, sensory deprivation, extremely painful “stress positions,” sensory bombardment (such as prolonged loud noise and/or bright lights), forced nakedness, sexual humiliation, cultural humiliation (such as desecration of holy scriptures), being subjected to extreme cold that induces hypothermia, exploitation of phobias etc.
Such evidences would have never found its place in US civil court, but with Military Commission Act of 2006, such techniques have found a way to crawl inside the justice. Even the experts are pointing out that, evidences gathered by using such techniques are unreliable and cannot be accepted. But Mr. Bush is determined to hand over death penalty to the alleged masterminds.
Even if the court finds alleged innocent, they won’t be freed. They will be detained for their life time and this is how the US Justice would feel the change.
How could a civilized country can accept use of such tortures? And if they accept it, then why they have problem when other countries use it? Why they term Hitler, a monster for using very same techniques and killing millions of people whereas they are also following same steps? For Hitler, Jews were not good enough to be humans and wanted to erase them. For US inmates in Guantanamo Bay are same, like Jews were for Hitler.
I am not saying here they are innocent. They might be very dangerous like US claims them to be. But at least, US can follow the justice system that it feels proud about and not promote use of torture of any form. Aren’t there other ways to get information? The guilty should be punished but that doesn’t mean punishing everyone suspected to be guilty.
But history suggest whatever US does is right and when other do, it’s crime. Look how stupidly US justice and US HR policy runs. When Saddam Hussein kills thousands of Kurds, it’s crime against humanity. When US soldiers erase whole village including innocent babies and women, then it’s not crime against humanity. No country can prosecute US soldiers for such crimes. And US just prosecute them in their own way.
This is how the US justice runs. Instead of being proud of their justice, they should be ashamed. With the US Presidential Election around the corner, Bush is trying hard to close this chapter before another President closes it. He wants some outcome which might help John McCain to win the US race.
The U.S. Supreme Court struck down an earlier system as unconstitutional in 2006, and is to rule this month on the rights of Guantanamo prisoners, potentially delaying or halting the proceedings.
Did Britain rule us?
2I was following up the international media’s reporting on Nepal turning to Republic and India’s NDTV’s homepage news attracted my attention. It has mentioned that:
Britain, Nepal’s former colonial ruler, sent its congratulations after the assembly’s first session.
What does this bold line means? Are Indian media unaware of the fact that Nepal has never been ruled by any other foreign countries? Or this symbolizes their sheer negligence towards us?

Unequal Citizens

I sat outside the lavish boutique, the display consisted of a lavishly done sari beautifully embodied making the mannequin more beautiful. Inside my giggling cousins were truing out dresses for Tihar ( The festival of lights celebrated in Nepal by burning oil lamps and bursting crackers ) and each time the other commented on the dress the duo burst out laughing ( girls I though). I fiddled with my cell phone and furiously typed an SMS to my cousin inside- let’s go please feeling bored! As I sat furious outside a little girl about 6 came near me and looked admiringly at the beautifully done mannequin.
The little girl who was highly impressed by the glitz inside the boutique she carefully tucked her plastic bag in her shoulder as a handbag , and dusted the speck of dust in her government blue school dress she was wearing and carefully touched the butterfly clip in her head that carefully parted he hair on each side.
Her mother called her name as she slowly guided her husband who was drunk, her mother looked embarrassed as her husband shouted absurdities and she was well aware of the stare being awarded by the passerby. The girl ran near her father and pulled his hand and said “father when we have enough money I want a beautiful sari just like that”, her mother told her to shut up and the little girl gave her a cold stare and again pulled her father’s hand and said “father I want green bangles” she fiddled through her faded plastic bangle in her little hand “we have money for that its just 30 rupees” she added stubbornly. Her mother again told her to shut up and dragged the girl along with her drunken father but the little girl was still nagging and demanding for her green bangles.
This really touched me as the girl who was barely six knew that her family was not financially strong to fulfill her desires. Where be the girl be in the future? I thought. Will she be just like her mother married at a young age; with a drunken unperturbed husband? And will her children share the same fate as her’s when she sees her child’s desires being raped by the inequality in the society.
God is biased I thought. Every one of us have bestowed equal fate in the almighty but his grace is bestowed upon only a few. There were people in this world enjoying amful wealth and in the other hand there were people who were uncertain about their future but still didn’t give up dreaming for a future they will never enjoy and dreams that will never materialize.
All the way home I just thought whether the little girl got her green bangles, as I listened to my cousins who fussed over the dress they had brought.
सबैको पार्टी माओवादी
3हुन्छ, हुँदैन भनेर सधैँ अल्मलिएको संविधान सभाको चुनाव भएको पनि १ हप्ता भईसक्यो । चुनावी परिणामहरु आइरहेको छ । र सबैलाई अचम्म पार्दै माओवादीले विजय पाएको छ । जित्न त जितेको हो तर यो माओवादी सबैको पार्टी कसरी भयो हँ ??
खासमा कुरा के भयो भने आजकाल जो भेटेपनि कुन पार्टीले जित्नुपर्ने कुन उम्मेद्धार कस्तो र के मा भोट हालियो भनेर कुराकानी हुने गर्छ । चाहे चिया पसल होस् या रेष्टुरेन्ट, चुनावको चर्चा अझै सेलाएको छैन । परिणाम देखेर माओवादीका समर्थकहरु त खुशी हुने भइनै हाले तर अरु पार्टीका समर्थकहरु पनि भित्र जतिसुकै रिस उठेपनि बाहिर चाहि निकै खुशी देखिदा रहेछन् ।
यही कुराको सिलसिलामा जो सँग पनि भोट के मा हालियो भन्ने कुरा हुने वित्तिकै माओवादीलाई भन्दा रहेछन् । हुन त के मा भोट हाल्यौ भनेर सोध्नु गलत हो तर अब मान्छेहरु आफै भन्छन् भने सुन्न के को गल्ती होइन र भन्या ? मलाई थाहा भएका कट्टर माओवादीका विरोधीहरु पनि अहिले आएर त मैले माओवादीलाई नै भोट दिए भन्न लजाउँदैनन् बाबा । हैन विजयको पछि सबै लाग्ने यो चाला हो कि आफ्नो पार्टीले हारेको दुःखलाई भुल्ने माध्यम हो ? त्यो त मलाई पनि थाहा भएन । अहिले सम्म झण्डै २ वा ३ जनाले मात्र आफुले भोट हालेको कुरा सही रुपमा मलाई भने । सबैले माओवादीलाई नै भोट हालेको डंका फुक्दै हिँडेपछि अब त भन्नै पर्ला जस्तो छ सबैको पार्टी माओवादी
Uphill task for Maoists
0Surprise….Surprise!!! Nepal’s CA elections have given unexpected verdict and CPN Maoists are heading for clean majority. Many pundits and analysts have believed that Maoists will merely be third largest party and democratic parties like Nepali Congress and CPN UML would be the leaders. But how wrong they were.
There are no clear answers to question; why Maoist doing so well. Maoists critics say their threat and intimidation prior to election played crucial role in judgment making process of Nepali people. But many believe Nepali people want change and they put their faith in Maoists. Whatever the arguments are, one thing is clear: Nepal Communist Party Maoists have emerged as big player in coming Constituent Assembly.
But there are daunting challenges lie ahead for Maoists. Using popular campaigns and luring public, they got the mandate. But in reality, it would be mountainous task for them to achieve their goals. First major concern is to see how international community will react to this election process. CPN Moaist has been vehemently opposed to policies of India and US. US haven’t removed Maoists from its list of international terrorist organization. International community particularly US and India must be in dilemma whether to accept the verdict or not. India is itself facing growing problem with Naxalist and supporting Maoists could send wrong signals to Naxalists. Whereas US doesn’t want to see victory of communism over capitalism.
So Maoists leadership would find itself in hot milk to assure international community about it intentions and commitment to democracy, liberty and human rights. With start they can do is: control unruly activities of its youth wing, Young Communist League (YCL), scrap its parallel kangaroo governments, return back all seized properties and allow people to return home. Oh man, I thought to write one but the list continued.
Their task is not only to assure international community but also to take all domestic player together and lead in constitution writing process. Besides that, they have look after administrative part too. They have to make everyone happy including its militias and Nepal Army. Not only that, they have to control escalating inflation and bring revolutionary economic reforms and increase pace of development.
These are only few problems. Many will come as time pass by. It was easy for them to comment but now, its their challenge to meet people’s aspirations. They have got 2 years to make people feel change, lets see how far they can go.
